I have been a legal professional for three decades. I’m an ex-serviceman and have been associated with Defence in one way or another for approximately 35 years.

I have learnt:

There are no certainties in life - except that if the government introduces something new, like the new military compensation scheme and tells you, you are going to be better off, the one certainty is that most of you will be worse off!

Some of our older clients will recall the introduction of the MSBS scheme to replace DFRDB in the early nineties. They told you you would be much better off. Remember? Need I say anymore?

Let me share with you a few truths about the military compensation system. Here are the ten biggest mistakes an injured ADF member can make when dealing with a compensation claim:

  1. Relying on MCRS to fill in the Compensation Form.
  2. Failing to obtain independent specialist medical advice (that is, advice from somebody who was not recommended by MCRS).
  3. Using a non-legally qualified advisor to help you with your claim; or what’s worse, not seeking advice at all.
  4. Accepting MCRS’s view as to whether you have an injury giving you a right to compensation.
  5. Accepting the opinion of an MCRS doctor without having it independently checked.
  6. Thinking that MCRS have your best interests at heart when you’re injured. Just look at the testimonials on our website or ask thousands of our clients what their experience was with MCRS.
  7. Believing MCRS will quickly determine your claim – they move with the speed of a glacial caterpillar.
  8. Accepting an offer without seeking independent legal advice – we see many clients who are tens of thousands of dollars worse off than they should be by accepting MCRS’s advice.
  9. Thinking the compensation process is “soldier” friendly.
  10. Accepting MCRS’s view as to which compensation system is best for you.
